These terms govern your use of brainylab.io. The cookie policy in the second part of this page explains which cookies the website uses and how you control them.

1.About these terms

These terms and conditions apply to everyone who visits or uses the website at brainylab.io (the “website”), including when you submit a form on it. By using the website you accept these terms. If you do not agree with them, please do not use the website.

3.Using the website

The website is intended for businesses and for adults acting on their behalf. You may use it only for lawful purposes and in line with these terms. You must not:

  • attempt to gain unauthorised access to the website, its servers or any connected system;
  • interfere with the website’s operation, or introduce viruses or other harmful code;
  • use bots, scrapers or other automated means to access or copy the website, except standard search engine indexing;
  • send spam, false information or another person’s details through our forms;
  • impersonate any person or company, or misrepresent your connection to them.

We may restrict or block access to the website for anyone who breaches these terms.

4.Forms, calls and newsletter

When you book a call, request a report or sign up to our newsletter, you confirm that the information you provide is accurate and that you are authorised to share it, including on behalf of your company.

  • No contract. Booking a call or sending a request is not an order, and our replies are not a binding offer. Work starts only once both sides sign a written agreement.
  • Calls. We may decline, reschedule or cancel a call at our discretion.
  • Newsletter. The brainylab Playbook is free. You can unsubscribe at any time through the link in every email.

We handle the personal data you submit as described in our privacy policy.

5.Calculators, reports and demos

The lead calculator, the engagement report and the game demos on the website are illustrations. Their results depend on assumptions and on the information you enter. They are not a quote, a forecast or a promise of any result for your business.

Demos are provided for viewing and trying out only. We may change or withdraw them at any time.

6.Intellectual property

All content on the website, including text, design, illustrations, images, videos, games, software code and the brainylab name and logo, belongs to brainylab d.o.o. or its licensors and is protected by copyright and other laws. All rights are reserved.

You may view the website in your browser for your own information. Without our prior written permission you may not copy, reproduce, modify, distribute, publish, frame or otherwise use any of its content, in whole or in part, for any purpose. This includes text and data mining and the training of AI systems; we expressly reserve these rights under Article 4(3) of Directive (EU) 2019/790.

Client names, logos, trademarks and project work shown in our case studies belong to their respective owners and are shown with their permission. Nothing on the website grants you any right to use them.

7.Third-party links

The website links to websites and services run by others, such as social networks and video platforms. We do not control them and are not responsible for their content, availability or privacy practices. Their own terms apply when you use them.

8.Liability

We work to keep the website accurate and available, but we provide it “as is”. We do not guarantee that it will be uninterrupted, error-free or free of harmful code, or that its content is complete and up to date. The content is general information, not professional advice for your situation.

To the extent permitted by law, brainylab d.o.o. is not liable for any indirect or consequential loss, lost profit, lost data or business interruption arising from your use of the website or your reliance on its content. We may change, suspend or discontinue any part of the website at any time.

Nothing in these terms limits our liability for damage caused intentionally or through gross negligence, or any liability that cannot be limited under applicable law, including the mandatory rights of consumers.

9.Changes

We may update these terms and the cookie policy from time to time. The effective date at the top of this page shows when they last changed. The version published here applies from that date, so please check it when you return.

10.Governing law and language

These terms are governed by the law of the Republic of Slovenia, excluding its conflict of law rules. The courts in Ljubljana have jurisdiction over any dispute arising from them. If you use the website as a consumer, you keep the protection of the mandatory laws of your country of residence and may bring a claim there.

These terms are written in English. If we publish them in another language and the versions differ, the English version prevails, unless mandatory law requires otherwise.

11.Cookie policy

Cookies are small files a website stores in your browser. Similar technologies, such as pixels and browser storage, work in a comparable way. In this policy we call all of them “cookies”.

The website uses cookies only where they are strictly necessary, or where you have agreed to them in our cookie banner. Until you make a choice, nothing other than strictly necessary cookies is set.

14.If you decline

If you decline analytics or marketing cookies, the tools in that category do not set or read cookies in your browser. We use Google Consent Mode, so Google’s tags may still send limited signals without cookies, such as that a page was loaded and which consent you gave. Google uses them only in aggregate to estimate overall results.

15.Transfers outside the EU

Google and Meta may process data from their cookies in the United States. Both are certified under the EU–US Data Privacy Framework, and also rely on the European Commission’s standard contractual clauses.

16.Your choices

  • Change your mind. You can change or withdraw your consent at any time through the Cookie settings link in the website footer. Withdrawing consent does not affect use that happened before.
  • We ask again. We ask for your choice again after 6 months, or sooner if we add a new tool.
  • Browser settings. Your browser lets you delete or block cookies. If you block strictly necessary cookies, the website may not work properly.

17.Contact
